Acceptance of Terms

Welcome to Apollo (“Apollo,” “we,” “our,” or “us”). These Terms of Use (“Terms”) govern your access to and use of the Apollo mobile application, website, and related services (collectively, the “Platform”). By using Apollo, you agree to be bound by these Terms. If you do not agree, please do not use Apollo.

Eligibility

  • You must be 18 years or older and have a valid photograph identification to use the Apollo Platform.

  • By creating an account, you confirm that the information you provide is accurate, current, and complete.

The Apollo Platform

Apollo provides:

A digital identity and venue access system for nightlife entry and verification.

  • Features including:

    • Venue and staff sign-in,

    • User entry verification,

    • Buddy system & real-time venue activity,

    • “Angel Alert” safety notification system,

    • Data analytics for venues and brands,

    • Advertising and promotional displays.

We may add, modify, or remove features at any time without prior notice.

User Responsibilities

You agree to:

  • Use Apollo lawfully and only for its intended purposes.

  • Not share your account with others or impersonate another person.

  • Not tamper, reverse engineer, or misuse the Platform, including its verification and safety systems.

  • Respect venue rules and any instructions provided by venue staff.

  • Make payment of the required (when applicable) fee.

  • Ensure to provide Apollo accurate and complete information.

Venue Rules & Responsibilities

  • Each venue maintains its own independent entry policies, codes of conduct, and safety rules.

  • Apollo only facilitates identity verification and access management and does not govern or override venue rules.

  • By using Apollo to access a venue, you agree to comply with all venue policies, including dress codes, entry restrictions, and conduct requirements.

  • Apollo is not liable for disputes, damages, injuries, or incidents that occur at or in connection with a venue.

  • Use of Apollo does not guarantee entry into any venue; admission decisions remain solely with venue management.

Safety Features

  • Apollo provides tools (such as the Angel Alert) to promote user safety, but we cannot guarantee your safety.

  • You remain responsible for your own actions and wellbeing.

  • Apollo is not an emergency service; always contact local authorities in the event of an emergency.

Privacy & Data Protection

  • Apollo collects and processes personal data (including ID details, contact information, location data, and usage analytics) in line with our Privacy Policy.

  • By using Apollo, you consent to your information being processed and securely stored.

  • Apollo may verify your identity through third-party systems, including but not limited to government databases (such as the Department of Home Affairs) or licensed verification providers.

  • Apollo does not control these third-party systems and is not responsible for errors, downtime, or verification outcomes.

  • We comply with POPIA (Protection of Personal Information Act, 2013) and relevant global data protection laws.

  • Apollo may share limited technical or device data with approved fraud prevention or security partners, where needed to verify identity or prevent misuse, in line with our Privacy Policy.

Venue & Brand Interactions

  • Venues and brands may publish offers, promotions, or advertisements on the Apollo Access platform.

  • Apollo does not endorse, guarantee, or take responsibility for the accuracy, or quality of third-party content.

  • Any disputes with venues, staff, or brands are strictly between you and the third party.

Intellectual Property

  • All intellectual property rights in Apollo (software, design, trademarks, and content) belong to Apollo Access (Pty) Ltd.

  • You may not copy, distribute, modify, or exploit Apollo or its content without prior written consent.

Disclaimers & Limitation of Liability

  • Apollo is provided “as is” and “as available.” We make no guarantees regarding uninterrupted service, error-free operation, or absolute safety.

  • To the maximum extent permitted by law, Apollo is not liable for any damages, losses, or harm (direct, indirect, incidental, or consequential) arising from your use of the Platform.

  • Liability Cap: Apollo’s total liability for any claim shall not exceed the greater of (a) the total fees you have paid (if any) in the six (6) months before the claim, or (b) ZAR 1,000.

Indemnity

You agree to indemnify and hold harmless Apollo Access (Pty) Ltd, its directors, employees, and partners from and against any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:

  • Your misuse of the Platform,

  • Your violation of these Terms, or

  • Your breach of venue rules or third-party agreements.

Termination

  • We may suspend or terminate your account at any time if you violate these Terms or misuse the Platform.

  • You may delete your account at any time through the app or by contacting Apollo Support.

Governing Law

These Terms are governed by and construed under the laws of South Africa, without regard to conflict of law principles.

Updates to These Terms

We may update these Terms from time to time. Continued use of Apollo after updates constitutes acceptance of the revised Terms.

Conditions of use and access

  • In order to make use of Apollo's services, you must register as a customer.

  •  You must ensure that all the details provided for registration are true and correct at all times as Apollo shall not be liable for any expenses, costs or damages incurred as a result of incorrect details.

  • Your are responsible for securing your login password and such login password may not be disclosed to third parties.

  • You must immediately notify Apollo in writing of any unauthorized use of your login or password or of any other breach of security.

  • When you register as a customer, you consent to receiving communications from Apollo electronically.

  • Apollo may suspend your account or limit your usage if you your account with Apollo is in arrears.

Suspension of accounts

  • Apollo reserves the right to suspend any customer account if it suspects any corrupt, illegal or fraudulent activity is linked to that account.

  • Apollo reserves the right to investigate any suspected corrupt, illegal or fraudulent activity in relation to a customer account, without prior notice and keep such customer account suspended until the investigation is finalised.

  • A customer whose account has been suspended has the right to make representations to Apollo, requesting reasons for such suspension of the account and to also provide proof and or reasons for the legitimacy of any suspected illegal, corrupt or fraudulent activity.

  • Apollo will reactivate a suspended customer account only once it has been satisfied that no corrupt, illegal or fraudulent activity is linked to that customer account.

  • Apollo reserves the right to verify any customer account before reactivating such account.

 Payment

  • After successful registration, you may select the type of payment method if multiple payment options are available to use the Apollo service.
